By creating a tenant account or using the Anvil platform ("Service", "Platform"), you ("Tenant", "You") agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms govern Tenant use of Anvil. End-customer SMS recipients are governed by the Anvil SMS Disclosure and the Anvil Privacy Policy.
Anvil is a multi-tenant field service management software platform operated by ZONDE LLC ("Zonde"). The Service allows HVAC, plumbing, and similar service businesses to:
You must provide accurate information when creating a tenant account. You are responsible for maintaining the security of your login credentials and for all activity under your account. You must be at least 18 years old and legally authorized to enter agreements on behalf of your business.
Notify us immediately at [email protected] if you suspect unauthorized access.
We continuously develop and improve the Service. We may add, modify, or discontinue features over time. We will use commercially reasonable efforts to give You reasonable advance notice of any change that materially and adversely affects Your use of the Service, and of any change to pricing, these Terms, or how Your data is handled.
Your continued use of the Service after a change takes effect constitutes acceptance of that change. Service availability and warranty terms are described in Sections 9 and 11.
You own your customer data. All customer records, service history, schedules, and other Tenant data submitted to or generated by the Service belong to You. Zonde acts as a service provider (data processor) with respect to that data, processing it solely on Your instructions to operate the Service. We will not sell, share, rent, or transfer Your customer data to any third party except as required by law or as described in our Privacy Policy.
Upon account termination, we will provide a data export within 30 days of written request to [email protected].
If You enable SMS-based appointment confirmations, reminders, or other customer-facing SMS features, You represent and warrant that:
Zonde provides automated STOP/HELP keyword handling at the platform level: any customer who replies STOP to a Zonde toll-free number is automatically unsubscribed by the carrier and Twilio (Zonde's SMS delivery provider) and will not receive further SMS, regardless of Your individual records.
You agree to indemnify Zonde for any claim, fine, or damage arising from Your failure to obtain proper consent from a customer prior to enabling SMS for that customer.

By creating a tenant account, You consent to receive transactional emails from Zonde (email verification, password reset, account notifications, billing, security alerts).
Zonde may also send You operational SMS related to Your tenant account (security alerts, system status). These are not subject to a separate opt-in and are part of operating Your account.
We will use commercially reasonable efforts to maintain the availability of the Service. However, we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control.
We are not liable for interruptions caused by third-party telecommunications carriers, internet service providers, power outages, or force majeure events. SMS delivery in particular is subject to carrier filtering and network conditions outside Zonde's control.
All rights, title, and interest in the Service (including software, trademarks, and documentation) belong to Zonde. Your use of the Service does not grant You any ownership rights beyond the limited license to use the Service as described in these Terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that SMS messages will be delivered without delay, that the Service will meet Your specific business requirements, or that the Service will be available 24/7.
IN NO EVENT SHALL ZONDE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
Zonde's total aggregate liability shall not exceed the amount paid by You to Zonde in the six (6) months preceding the claim.
Zonde is not liable for any damage, loss, or injury resulting from missed or undelivered SMS, delayed notifications, network outages, customer responses (or non-responses) to confirmation messages, or carrier filtering.
You agree to indemnify and hold harmless Zonde from any claims, damages, fines, or expenses (including reasonable attorneys' fees) arising from:
You may close Your tenant account at any time by contacting [email protected]. We may suspend or terminate Your account if You violate these Terms (in particular, if Your SMS sending practices are flagged for non-compliance) or if the Service is discontinued.
Upon termination, Your right to use the Service ceases immediately. You may request a data export within 30 days of termination.
We may update these Terms as the Service evolves. Material changes will be communicated via email to registered tenants at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance.
These Terms shall be governed by the laws of the State of Rhode Island, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Rhode Island.
